Rivkin Radler is unique in that it is one of the few law firms that has a designated insurance fraud & recovery practice group. The practice group was formed approximately 20 years ago and now consists of more than 40 legal professionals at both the partner and associate level that spend either all, or a considerable amount, of their time working with insurers to proactively address all aspects of fraud through investigation and litigation.  Put quite simply – there is no learning curve, as we are widely recognized among insurers as one of the “go-to” firms in the anti-fraud arena.

Our footprint is national in scope, involving the ongoing investigation and prosecution of matters in more than a dozen states over the past five years, covering fraud schemes relating to both claims and insurance underwriting perpetrated by individuals and entities associated with healthcare providers, lawyers and other licensed professionals, autobody shops and glass vendors, funding companies, utilities, remediation companies, ride share companies and public adjusters.

Our role is to implement the best, most cost-efficient methods to assist our clients in achieving sustainable outcomes because fraud schemes constantly evolve and take new forms. While affirmative litigation is an important part of that philosophy, it is only one part of the integrated fraud and deterrence plans that we assist our clients in developing.

The group is managed and driven by a team of partners, the majority of whom have been involved in the insurance fraud arena for more than a decade, and many of whom are former prosecutors.  We bring to the table a deep expertise in insurance law, knowledge of the insurance fraud landscape, and experience in developing anti-fraud plans (which include litigation) that produce strategic results for our clients.  We understand both the issues that drive insurance fraud as well as the tools that are available to insurers in their efforts to combat fraud. For example, the members of the practice group bring their years of experience in order to:

  • provide advice and counseling to insurers on the adoption and implementation of anti-fraud measures;
  • provide guidance to clients and assist them in their performance of insurance fraud investigations;
  • conduct examinations under oath of insureds, healthcare providers and others who submit claims to insurers;
  • litigate affirmative actions on our clients’ behalf to recover money and expunge fraudulent and unlawful claims.
