Elan Kirshenbaum

Elan Kirshenbaum is an Associate in Rivkin Radler’s Insurance Fraud Practice Group. He focuses on no-fault insurance fraud matters and helps insurers prosecute civil lawsuits under the Racketeer Influenced and Corrupt Organizations (RICO) Act. He also works with the firm’s insurance defense.

Prior to joining Rivkin Radler, Elan worked as an Associate at a firm with offices on Long Island and New Jersey, where he handled general liability, personal injury, and labor law cases. This work included drafting pleadings, motions, and oppositions; representing clients in court and appearing before various judges for conferences and proceedings; leading depositions; handling all aspects of discovery; and interfacing with opposing counsel to achieve optimal outcomes for both parties. In his final weeks at that firm, Elan negotiated settlements in three different general liability cases, including one case where he saved the insurance carrier $95,000 off a total settlement authority of $150,000.

During law school, Elan worked as a legal intern for the Suffolk County District Attorney’s Office and as a judicial intern for the Hon. James G. Clynes. At Cardozo School of Law, Elan served as Executive Editor of the Cardozo Journal of Conflict Resolution (Vol. 23). His Note was published in the Summer 2022 issue (“Twenty Yards From the End Zone: ADR, and the Potential for Greater Levels of Gender Equality in Professional Sports Employment”). Elan also worked as a Research Assistant for Professor Donna Erez-Navot and was selected from over 150 applicants for the 16-member Cardozo Mediation Clinic, earning certification as an Approved Mediator by the New York Peace Institute. Elan served as a Senator on the Student Bar Association over his 2L and 3L years and volunteered to be a Student Mentor in Cardozo’s May Mentors Program. At graduation, Elan qualified as one of 10 students in the class to earn a Certificate in Dispute Resolution, and he was presented with the 2022 Steven Eric Tanenbaum Leadership Award by the Cardozo faculty.

In his spare time, Elan enjoys hanging out with friends, attending Broadway and off-Broadway shows, relaxing with his favorite movies and TV shows, and rooting for the Yankees and Jets.
