Elan wants to make a difference in the lives of others through meaningful work. He enjoys the investigative aspect of insurance fraud, allowing him to piece together the details of each case while pursuing justice for his clients. He attributes success in his career to the support and inspiration derived from his family and friends.
Elan Kirshenbaum is an associate in Rivkin Radler’s Insurance Fraud Practice Group. He focuses on no-fault insurance fraud matters and helps insurers prosecute civil lawsuits under the Racketeer Influenced and Corrupt Organizations (RICO) Act. He also works with the firm’s insurance defense practice.
Elan works in the no-fault car insurance space. He writes complaints against health care clinics and practitioners committing personal injury protection (PIP) insurance fraud. He also handles all aspects of discovery, drafts settlement agreements and motions, and conducts examinations under oath.
Elan has experience handling general liability, personal injury, and labor law cases. This includes drafting pleadings, motions, and oppositions; representing clients in court; appearing before various judges for conferences and proceedings; leading depositions; and interfacing with opposing counsel to achieve optimal outcomes for both parties.
During law school, Elan worked as a legal intern for the Suffolk County District Attorney’s Office and as a judicial intern for the Hon. James G. Clynes. At Cardozo School of Law, Elan served as executive editor of the Cardozo Journal of Conflict Resolution (Vol. 23). His note was published in the Summer 2022 issue (“Twenty Yards From the End Zone: ADR, and the Potential for Greater Levels of Gender Equality in Professional Sports Employment”). Elan also worked as a research assistant for Professor Donna Erez-Navot and was selected from over 150 applicants for the 16-member Cardozo Mediation Clinic, earning certification as an Approved Mediator by the New York Peace Institute. Elan served as a senator on the Student Bar Association during his 2L and 3L years and volunteered to be a student mentor in Cardozo’s May Mentors Program. At graduation, Elan qualified as one of 10 students in the class to earn a Certificate in Dispute Resolution, and he was presented with the 2022 Steven Eric Tanenbaum Leadership Award by the Cardozo faculty.
In his spare time, Elan enjoys hanging out with friends, attending Broadway and off-Broadway shows, relaxing with his favorite movies and TV shows, and rooting for the Yankees and Jets.
