Rivkin Radler’s Strategic Alternative Defense Team integrates and merges the collective knowledge of the Firm’s Insurance Fraud group and its General Liability group in the defense of self-insured businesses; property owners; and private, commercial, and automobile insurers against suspicious personal injury claims in the downstate New York region as well as other metropolitan areas.

Our team, which includes several former criminal prosecutors, utilizes firm resources to track claims and analyze historical institutional data while also using outside-of-the-box strategies to obtain key discovery and other information during the defense of a case. By utilizing investigative strategies that are more traditionally geared towards affirmative fraud litigation, we seek to identify critical issues and fact patterns, including staged accidents, overutilized or unnecessary medical treatment, litigation funding, and questionable causative opinions, to effectively defend our clients in today’s challenging liability landscape. The merging of these groups enables us to provide a unique perspective in the recognition and defense of potentially fraudulent and questionable claims.
