Strober Obtains Dismissal in Toxic Mold Case

Eric Strober obtained the dismissal of a case sounding in exposure to toxic mold in a client’s co-op unit rented by the plaintiff.  The plaintiff was a doctor who claimed that, due to illnesses sustained as a result of exposure in the apartment, that she was unable to work as a dermatologist and had to leave New York City.  She was seeking a multi-million dollar recovery based on claimed lost earnings and the defendant had no insurance coverage.  Judge Barbara Jaffee of the New York County Supreme Court dismissed the case on statute of limitations grounds after Strober established that all of the illnesses and complaints made began more than three years before the suit was filed.
