Strober and Hecker Prevail in Anesthesia Negligence Suit
September 1, 2026 |Eric Strober and Nicole Hecker obtained summary judgment on behalf of their client, a urologic surgeon, and the surgeon’s ambulatory surgery center in a case alleging the negligent administration of anesthesia medications.
It was alleged that the codefendant anesthesiologist administered the incorrect medication to the patient at the beginning of a surgical procedure. The anesthesiologist attempted to shift responsibility by claiming that the surgery center had failed to properly label the medications in the anesthesiology cart.
The court agreed with our argument that the sole responsibility for the proper administration of anesthesia medications rested with the anesthesiologist. We had also established that neither the surgeon nor the practice had committed malpractice in any manner and did not have any responsibility for the administration of the medications to induce anesthesia.
