The Federation of Defense & Corporate Counsel (FDCC) will be holding its annual meeting from July 23 – July 30 in Charlevoix, Quebec. Alan Rutkin will participate in a panel discussion at the event.

A Recipe for Controversy: Evaluating the Availability of Coverage for Atypical Claims

Insurers on both sides of the US-Canadian border must navigate carefully when policyholders seek defense and/or indemnification coverage for potentially high exposure civil or criminal lawsuits that assert claims that do not fit neatly into the traditional categories of property damage, bodily injury, crime theft, and/or personal and advertising injury coverage. Our panel of experienced coverage counsel will guide us through an interactive and informative discussion of emerging trends, including the criminalization of torts and new types of privacy and misleading advertising claims, that require insurers to chart new territory in the coverage realm. Examples include issues arising from the Volkswagen software manipulation debacle, the $12 million Starkist class settlement, GM ignition switch claims, and theft of $5 million in Bitcoin currency.
