Robertelli Obtains Summary Judgment for Contractor in Superstorm Sandy Case
May 9, 2018John Robertelli obtained a dismissal of all negligence claims with prejudice made against a Home Renovation Contractor related to a dispute over work performed pursuant to a contract after the home was damaged by Superstorm Sandy. The negligence-related claims were dismissed by the Honorable Marc Troncone J.S.C. in Ocean County who held that the expert report proffered by plaintiff was a net opinion and therefore, plaintiff could not establish that the work performed breached any standard of care applicable to construction work in the industry. Judge Troncone also issued an order that barred a supplemental expert report which plaintiff attempted to serve well beyond the discovery end date and on the eve of trial.
