Mascia Obtains H-1B Visa for a Regulatory Affairs Manager from India

The firm’s client, a pharmaceutical manufacturing and packing company, hired a Regulatory Affairs Manager who had been sponsored for an H-1B visa by a previous employer.  Because the validity of an H-1B visa is specific to the sponsoring company, the firm filed an H-1B transfer petition and proved to the satisfaction of the United States Citizenship and Immigration Service (“USCIS”) that the employee’s new position met the definition of “specialty occupation.”  The firm obtained a successful outcome without receiving a costly request for evidence (RFE) from USCIS.
