Rivkin Scores Jury Verdict for Geico

A jury trial in Tampa, FL, results in a jury verdict for Geico. The case, handled by Lindsey Trowell, Ariane Smith, and Tim Ross, related to a provision in the insurance policy that required an inspection of the damage before repair, replacement, and/or disposal. The glass vendor has a practice of identifying Geico insureds, advising the insured to ignore the inspection provision, and quickly replacing the windshield and submitting a bill to Geico.

Geico argued that the insured failed to comply with the policy and therefore, no payment was due. The glass vendor argued that it stored the damaged windshield and that constituted substantial compliance and that Geico failed to come inspect it. The jury agreed with Geico and not only found that the insured failed to comply with the condition of the policy but also found that Geico was prejudiced by such conduct.
