Lagios and Tartaglia Obtain Pre-Answer Dismissal in Civil Rights Action

James P. Lagios and Stanley J. Tartaglia, Jr. obtained dismissal on behalf of their client, an attorney, in a civil rights matter before the U.S. District Court, Northern District of New York.

The plaintiff asserted multiple constitutional claims arising from a co-defendant school district’s investigation into charges of bullying, harassment, and racial discrimination of his son at a local high school.  Among other things, the Court held that our client was not a “state actor” and that, in any event, the plaintiff failed to state a legally cognizable constitutional claim arising out of any conduct on our client’s part.
