Intellectual Property Team Clears Challenge For Fees
January 20, 2021 |Greg Miller, Nancy Del Pizzo and J’Naia Boyd overcame a motion for reconsideration of a federal magistrate judge’s report and recommendations where defendants had sought compensation from our clients in the six figures in this trademark action. Our Intellectual Property team convinced the district judge that the case is not “exceptional” under the Lanham Act, and thus, no fees should be awarded. The opinion takes defendants to task for rehashing the same arguments they put before the magistrate judge.
