Holahan Achieves Dismissal

Frank Holahan successfully achieved dismissal of an action in the District of New Jersey against the estate of a deceased attorney and obtained an order to compel arbitration before the American Arbitration Association.  Plaintiff had argued that the arbitration clause in the parties’ retainer agreement is void as unconscionable, but the Court upheld a right to contractually agree to arbitrate and found the dispute within the scope of that clause.
