Glambosky and Meisel Defeat Tenant’s Illegal Lockout Claim

In a hotly contested proceeding in New York County Landlord-Tenant Court, wherein our landlord client was facing potential liability for treble damages and an order directing restoration of possession to the tenant, Erez Glambosky and Matthew Meisel successfully persuaded the Court to dismiss the tenant’s petition, with prejudice, and grant a judgment in favor of the landlord.

Notably, the Court was persuaded by the novel legal arguments supplied by Glambosky and Meisel, which demonstrated that tenant had no possessory rights and, at best, was a licensee who would ultimately be subject to an eviction even if he prevailed in the proceeding.
