DiGennaro and Fyman Victorious in Ray v. Watnick

Janice DiGennaro and Avigael Fyman were victorious in a motion to dismiss claims under Judiciary Law Section 487 brought against our attorney clients in Ray v. Watnick. Section 487 makes it a misdemeanor for an attorney to engage in any deceit of a court and also provides for the recovery of treble damages.  The motion was argued before Judge Rakoff in the Southern District who ruled from the bench and dismissed the complaint . The Judge indicated that since the issues raised in the motion were “interesting,” his written opinion will follow.
