Bruno and Isaacson Obtain Pre-Answer Dismissal of Counterclaims

Jonathan Bruno and Debbie Isaacson secured a pre-answer dismissal in the Supreme Court, New York County of counterclaims for sanctions and punitive damages against their law firm client.  Their client brought an action on a guarantee to pay legal fees for the services they provided in a matrimonial action, and the defendant, in response, claimed that our client’s attempt to recover the unpaid legal fees was both frivolous and warranted an award of punitive damages.  In granting our motion to dismiss, the court agreed that our client’s conduct was neither frivolous nor rose to the level that would warrant punitive damages.

This is the second significant victory that Jon and Debbie obtained on behalf of this client.  They were also successful in dismissing a majority of the legal malpractice claims filed against the client in a related action.
