The Title Reporter

July 1, 2020 | Insurance Coverage

Welcome to the Summer 2020 issue of Title Reporter: A Legal Update for the Title Insurance Industry. This inaugural issue of this quarterly newsletter covers a wide range of recent decisions by courts across the country involving title insurance.

Here, we explore how courts have calculated loss, addressed the doctrine of subrogation in the context of a title insurance policy, applied exclusions, interpreted “public records,” and handled an arbitration award.

In addition, this issue of Title Reporter reviews a decision in a case in which insureds sought to hold a title insurer liable for a title agent’s alleged negligence as well as an opinion by the Supreme Court of Washington finding that a title insurer had breached its duty to defend its insureds against a Native American tribe’s claim under an 1854 Treaty.

And, there’s more.

Of course, we welcome your feedback.

We hope that you and yours are well, and that you all stay safe,

David P. Leno, Peter P. McNamara, and Matthew V. Spero
