Del Pizzo Discusses ChatGPT with Law.com

Nancy Del Pizzo was quoted in the May 22 article of the Law.com article, “ChatGPT Faces Defamation Claims. Will Section 230 Protect AI Chatbots?” The article discusses whether AI chatbots will be protected under Section 230.

“For example, Nancy Del Pizzo, co-chair of Rivkin Radler’s Intellectual Property Practice Group noted that, “even if a website or media company publishes third-party content…[if] they’re editing it, they would lose their immunity.”

Still, Del Pizzo noted that she expects to see companies behind AI-powered chatbots try to use Section 230 as a defense—but whether it will be successful is less certain.

“I think that it’s a viable defense. I don’t know if it’s going to be a successful defense…. The AI companies will need to convince a court that it’s third-party content that they’re providing and that they’re not contributing to the creation or development of the content,” she said. “I think that’s going to be key.”
