Richman and Romeo obtain summary judgment

David Richman and Jason Romeo obtained summary judgment on behalf of their client, Xenophon Xenophontas dismissing claims that the doctor committed medical malpractice in connection with the care and treatment of a patient who developed a deep vein thrombosis (DVT) following performance of back surgery at Mercy Medical Center. It was claimed that Dr. Xenophontas, a vascular surgeon, failed to timely diagnosis and treat the signs and symptoms of DVT.  In Rivkin Radler’s moving papers, Jason successfully argued that that there was no merit to the claim by plaintiff that our client should have ordered more extensive laboratory studies prior to surgery which would have found that the plaintiff was at a higher risk of developing a DVT.
