Korman and Mascia Victorious in Common Carrier Duty Case at the Appellate Division, First Department
April 22, 2016Cheryl F. Korman and Henry Mascia, members of the Firm’s Litigation & Appeals Practice Group, obtained a victory in a negligence case at the Appellate Division, First Department. In Morante v. Citywide Mobile Response Corp., the plaintiff commenced this action to recover damages for personal injuries allegedly sustained after she fell while exiting an ambulette owned and operated by the defendant. Mascia and Korman persuaded the First Department to affirm the Supreme Court order granting defendant summary judgment because the ambulette was safe and defendant had no duty to escort plaintiff down the ambulette steps.
