Lagios and Wagner Obtain Dismissal of Multiple Causes of Action

James Lagios and Mark Wagner, Jr. obtained the dismissal of a complaint on behalf of their client, a real estate broker, in a suit in which the plaintiff, the purchaser of a residential dwelling, asserted multiple causes of action based on breach of contract, negligent misrepresentation and fraud. The Court found the plaintiffs failed to allege any improper conduct that would support a breach of contract or fraud. Additionally, the Court found that the plaintiffs did not allege facts that would support a claim of active concealment.
