DiGennaro and Lastorino Score Legal Malpractice Win

Janice J. DiGennaro and Carol A. Lastorino obtained a major victory on a pre-answer motion to dismiss before Justice O. Peter Sherwood in New York County Supreme Court, Commercial Division.

The case involved a complex legal malpractice action against our client involving corporate restructuring, capital raise transactions and a merger with a public company, wherein plaintiffs made a $20 million settlement demand.

Justice Sherwood dismissed the complaint against the attorney defendant in its entirety and in doing so adopted every ground raised in support of the motion including failure to state a cause of action, release, documentary evidence, absence of causation, statute of limitations and ratification.
