Del Pizzo Argues Mock TRO and PI Motion with Colleagues in Educational Session

On Monday, May 14, 2018, Nancy Del Pizzo joined the Hon. Stanley R. Chesler, U.S.D.J., Thomas Meloro, a partner at Willkie Farr & Gallagher LLP,  and Brandon Fierro, an associate at Lowenstein Sandler LLP, to present on ex parte motions for Temporary Restraining Orders (TRO) and Preliminary Injunctions (PI) and PI motions, generally, to members of the John C. Lifland American Inn of Court at the New Jersey Law Center, New Brunswick, N.J.

Fierro gave an overview of the legal standards for TRO and PI motions, which was followed by a mock ex parte TRO motion argued by Del Pizzo before Judge Chesler. Del Pizzo and Meloro followed with a mock oral argument on a PI motion. Judge Chesler shared the do’s and don’ts of TRO an PI applications throughout the presentation, which was based on a fact pattern primarily developed by Meloro with help from Del Pizzo.

Nearly 100 people attended, including judges of the District of New Jersey and the Third Circuit Court of Appeals, as well as masters, barristers and students of the John C. Lifland American Inn of Court. Students of the Inn will take what they learned at the session to prepare for their own mock oral arguments to take place before District of New Jersey judges in the federal courthouse next month. The John C. Lifland American Inn of Court focuses on federal practice and intellectual property in particular. Nancy is a Lead Barrister at the Inn.

Feedback on the presentation was positive, with one master sharing that it was one of the best presentations he had seen in his 25 years of membership in the Inn.
