DeHaven Secures Dismissal for Demolition Contractor Client

July 16, 2018 | Construction | General Liability

George DeHaven handled Romero v 304-306 Canal Street LLC, a lawsuit arising from a job-site accident in which the plaintiff, a construction worker on the job, was injured by the falling ladder of a fire escape on the outside of a building adjoining the job site.

Our client, a demolition contractor, performed work only on the interior of the building under renovation and had completed its work well prior to the time of the accident. When the parties could not agree on a discontinuance, George moved for summary judgment and established that our client could not have been the cause of the falling ladder. The motion was granted and the complaint and all cross-claims were dismissed.
