Gordon & Spero Obtain Order From Bankruptcy Court Compelling Corporate Debtor To Surrender Premises To Building Owner

Stuart Gordon and Matthew Spero, members of the Firm’s Bankruptcy Department successfully obtained an order from the Southern District of New York Bankruptcy Court compelling a corporate debtor to immediately surrender premises to our client, a building owner.  The debtor had claimed that a previous tenant of the building had merged into the debtor, and that the debtor’s bankruptcy filing had resulted in an automatic stay that rendered the client’s previously obtained order of eviction void.  Stu and Matt were successful in convincing the Bankruptcy Court that any purported lease was deemed rejected by law as a result of the debtor’s failure to timely assume it in accordance with the Bankruptcy Code.
