Merril S. Biscone has focused her practice on appellate and complex litigation for almost 30 years. She has represented clients in more than 250 appeals in both state and federal court, as well as every other aspect of litigation.  Merril has successfully represented clients involving substantive and procedural issues relating to diverse areas of the law, including article 78 proceedings, attorney and accountant malpractice, civil procedure, commercial litigation, employment discrimination, insurance law, labor law, medical malpractice, municipal liability, no-fault law and premises liability.

As Counsel in Rivkin Radler’s Appeals Practice Group, Merril regularly prosecutes and defends appeals and engages in sophisticated motion practice before New York appellate courts and the U.S. Court of Appeals for the Second Circuit, and has argued hundreds of appeals and motions before these tribunals on behalf of insurance companies, hospitals, physicians, universities, public authorities, municipalities, property owners, construction management companies and others.

Merril is currently an Associate Village Court Justice for the Incorporated Village of Garden City – the first woman in the 131-year history of the village to serve in this capacity. Her duties include presiding over disputes involving the interpretation of the village code, vehicle and traffic law violations, and other issues affecting the lives of village residents and the business community.

Before joining Rivkin Radler, Merril served as Senior Court Attorney for the New York State Appellate Division, Second Judicial Department.

Merril’s publications include a paper submitted to the First Annual Long Island Insurance Law Symposium discussing the preparation of a threshold injury defense. She is also a member attorney of the USLAW Network, Inc., where she participates in the Retail, Restaurant and Premises Liability sections. In collaboration with other USLAW member firms, Merril is involved with updating the National USLAW Compendium of Law, specifically concerning issues of negligence in New York.

Merril was named a “Woman of Distinction” at the sixth annual Women of Distinction Awards Ceremony, an event that honors women who have had an impact on their communities through their commitment to bettering the lives of others.

Merril was named a Super Lawyer in the Metro New York area from 2018–2024.
