Marc A. Antonucci, a partner in Rivkin Radler’s Health Services; Compliance, Investigations & White Collar; and Commercial Litigation Practice Groups, focuses his practice primarily on healthcare, business and commercial transactions, and litigation.
A former General Counsel to one of upstate New York’s largest providers of services to individuals with intellectual and developmental disabilities, Marc brings years of multifaceted legal experience spanning corporate governance, complex commercial transactions, risk management, and regulatory compliance frameworks. As a trusted advisor to the executive team and Board of Directors, he helped align legal considerations with overarching business objectives and goals, working directly with the finance, human resources, information technology, facilities and maintenance, purchasing, development and grants, communications and marketing, and other support departments. He advised all of the agency’s operating divisions, including its: diagnostic and treatment center; nursing home; Article 16 Clinic, and residential and day programs under the Office for People With Developmental Disabilities; pre-school and primary education services; research and development center; foundation and endowment; mail fulfillment operations; and supplemental needs pooled-trusts.
During his career, Marc has counseled a wide variety of healthcare providers, including hospitals, drug and alcohol treatment centers, hospices, physician practices, professional corporations and companies, and medical professionals. His practice covers a full range of issues, such as mergers under the not-for-profit corporation law, negotiation of high-value agreements, vendor contracts and strategic partnerships, confidentiality of clinical records, data breach response, advance directives, tax exemption and real estate matters. He also represents not-for-profit organizations and closely held businesses.
Marc has substantial experience with corporate, regulatory, and anti-fraud and abuse compliance. His representational matters include internal and external investigations involving the federal False Claims Act, Anti-Kickback Statute, “Stark” law, Provider-Based Rule, and 340B drug discount program, among others. In addition, he has counseled clients in connection with U.S. Department of Health & Human Services Office of Inspector General (OIG) subpoenas and corporate integrity agreements, Centers for Medicare & Medicaid Services (CMS) additional document requests (ADRs) and targeted provider-specific prepayment reviews, and New York State Office of Medicaid Inspector General (OMIG) self-disclosures, structured reviews, and audits.
Marc began his legal career engaged in a broad range of complex commercial litigation matters for various clients, including many nationally known corporations. His litigated disputes involve such areas of the law as environmental contamination, toxic torts, highway design, management liability, catastrophic events, management of self-insured trusts, tax assessments and exemptions, insurance coverage and procurement disputes, as well as business transactions and governmental enforcement activity.
He is a member of the American Health Law Association, American Bar Association, and New York State Bar Association.
Prior to entering private practice, Marc served as a confidential law clerk for the Rhode Island Superior Court. He also worked as a Communications Coordinator for a member of the New York State Senate before attending law school.
Marc has served on the boards of several non-profit organizations. He resides in Loudonville with his wife, Courtney, and their daughter, Clara.
