Madison Torsiello is counsel in Rivkin Radler’s Commercial Litigation, Real Estate, and Construction Practice Groups, where she brings over a decade of experience advocating for clients in high-stakes business and real estate disputes across New York state and federal courts.

Madison’s practice focuses on complex commercial litigation, with a particular emphasis on landlord-tenant and real estate matters, including commercial lease disputes, holdover and non-payment proceedings, construction-related litigation, and business torts such as fraud, breach of contract, and reputational harm. She regularly advises commercial landlords, managing agents, developers, boards, and tenants on litigation strategy, risk mitigation, and dispute resolution, often in matters with overlapping regulatory or public relations concerns.

Her work is grounded in a client-first philosophy: She approaches each matter with empathy, strategic clarity, and a commitment to making clients feel like partners in their own litigation.

Madison is known for her tenacity in the courtroom and her ability to deliver results under pressure. In one notable matter, she obtained emergency injunctive relief on two days’ notice to halt an unlawful self-help eviction of a commercial tenant during the COVID-19 pandemic. Her strategic litigation ultimately resulted in the forgiveness of over $1 million in arrears and a six-month period for the client to relocate, saving the business. In another high-profile engagement, she defended a scientific not-for-profit organization against civil litigation and government scrutiny, helping to secure the reinstatement of a multi-million-dollar NIH grant and the dismissal of all New York state-related civil claims.

She is well-versed in e-discovery-heavy litigation, including multidistrict proceedings involving dozens of parties, complex discovery coordination, and reporting compliance with insurers and national defense teams. Her experience spans all phases of litigation: from pre-suit analysis and motion practice to oral argument, settlement negotiation, and trial preparation.

Prior to joining Rivkin Radler, Madison practiced at a Manhattan firm and clerked for the Honorable W. Franc Perry, J.S.C., in the Supreme Court of New York County.

In law school, Madison was a Dean’s List honoree, member of the International Law Journal, and recipient of the Archibald R. Murray Public Service Award. During her undergraduate studies, she captained the competitive policy debate team.

Outside of work, Madison enjoys playing competitive darts, skiing, and fishing.
