Before pursuing a career in law, Joshua was a professional jazz saxophonist. He draws upon his creativity and artistic background to develop innovative solutions for his clients. They value his promptness, reliability, and thoughtful approach to legal problem-solving.
Joshua D. Smith is a commercial litigator and health care attorney.
As a litigator, Joshua has wide-ranging experience representing insurers, health care providers, and individuals in complex litigation, including federal lawsuits brought under the Racketeer Influenced and Corrupt Organizations (RICO) Act. Joshua has obtained multimillion-dollar judgments against individuals involved in schemes to defraud New York’s no-fault system and successfully defended individual and corporate clients sued in multimillion-dollar fraud and breach of contract cases. Joshua’s diverse litigation practice has included representing clients in arbitration, mediation, federal and state court litigation, and appellate tribunals in matters ranging from first-party insurance claims to highly complex commercial disputes.
As an adviser, Joshua has counseled insurers and health care providers on a variety of issues affecting their industry, including federal and state laws prohibiting physician self-referrals, the federal and state anti-kickback laws, medical marijuana and CBD, claims-handling processes, and complex fraud investigations.
While at George Washington Law, Joshua served on the school’s moot court board and won the school’s International Law Moot Court Competition.
Joshua is an accomplished jazz saxophonist with numerous credits to his name. He is also an avid hiker and backpacker.

Joshua is actively involved in the American Bar Association (ABA) and currently serves as vice-chair of the Business Litigation Committee in the ABA’s Tort Trial and Insurance Practice Section (TIPS).
