Strober and Becker Prevail on Summary Judgment in Dental Malpractice Case

Eric Strober and Noah Becker were successful in obtaining dismissal of a dental malpractice action venued in the Bronx. The plaintiff’s allegations centered around the alleged negligent extraction of plaintiff’s tooth number 7. Strober and Becker made out their prima facie case by demonstrating that the plaintiff’s tooth was not salvageable and that, regardless, their client did not extract the plaintiff’s tooth. In support of their papers, Strober and Becker submitted an expert affidavit from their own client to establish the requisite standard of care. In opposition, the plaintiff’s failure to obtain an affidavit of an expert in the field of dentistry proved fatal.
