Robertelli Secures a Dismissal With Prejudice for a South Jersey Home Renovation Contractor

In a case involving a claim for property damage allegedly caused by the work of a contractor/developer that was in the process of renovating an adjacent condominium unit, John Robertelli secured a dismissal with prejudice of Plaintiff’s Complaint after a settlement reached was disputed by Plaintiff. Plaintiff filed a motion to enforce the settlement claiming that the remedial work performed did not comply with the terms of the settlement agreement. After extensive post- settlement motion practice, Cape May County Superior Court Judge J. Christopher Gibson agreed that the insured/contractor fully complied with the terms of the settlement agreement and rejected all of Plaintiff’s remaining claims.
