Rivkin Radler Names Malerba & Kutner Health Services Co-Chairs

NEW YORK – – January 20, 2017 – Evan H. Krinick, Managing Partner of Rivkin Radler LLP, has announced today that partners Benjamin P. Malerba and Christopher J. Kutner have been named co-chairs of the firm’s Health Services Practice Group.

Benjamin Malerba counsels a cross-section of healthcare providers and facilities, including IPAs, ACOs, provider networks, ambulatory surgery centers, diagnostic and treatment centers, hospitals and federally qualified health centers, on general healthcare business transactions, state licensing issues, corporate practice of medicine and regulatory compliance, disputes with managed care companies, and federal and state statutes and privacy laws.  His practice also covers data breach and response, cybersecurity and data security, with a particular focus on security breaches covered under the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Christopher Kutner’s clients include managed care organizations, physician groups, hospitals, and ancillary service providers, including laboratories, healthcare benefit administrators, and suppliers of medical equipment. His practice includes the representation of healthcare providers who are being audited or investigated by state and federal authorities.  Moreover, he advises healthcare providers with managed care contracting and dispute resolution and with respect to compliant practice structures and permissible arrangements concerning, among other issues, referrals. Prior to joining the firm, Mr. Kutner served as General Counsel and Compliance and Privacy Officer of a regional managed care organization in New York.
