Evan H. Krinick, Managing Partner of Rivkin Radler LLP, is pleased to announce that Avigael Fyman, Ryan Goldberg, Matthew Lampert, Robert Maloney, Sean McAloon and Frank Misiti have been elected Partners.

Avigael C. Fyman, of West Hempstead, is a member of the Professional Liability; Directors & Officers Liability; and Privacy, Data & Cyber Law Practice Groups.  Fyman represents attorneys, accountants, directors and officers, insurance agents, brokers and third-party administrators in suits alleging malpractice, breach of fiduciary duty, negligence, defamation, fraud, misrepresentation and ethical violations.  She defends technology companies in claims involving the enforceability of terms of service and has counseled insurers on coverage issues under cyber liability policies. She also advises insurers on coverage issues.

Ryan Goldberg, of Merrick, is a member of the Insurance Fraud Practice Group.  He helps insurers achieve multimillion-dollar judgments and settlements in fraud cases and has helped develop case law that is used to combat insurance fraud.  Goldberg has particular experience fighting fraud in the healthcare and automobile industries.  He represents national and regional insurers in actions to recover payments to physicians, medical clinics, attorneys, public adjusters and others as part of complex, large-scale insurance fraud and kickback schemes.  Many of Goldberg’s cases are cited as legal authority supporting the use of civil RICO statutes to fight insurance fraud.

Matthew A. Lampert, of Commack, is a member of the Compliance, Investigations & White Collar and General Liability Practice Groups.  Lampert defends a wide variety of clients in personal injury, premises liability, construction/labor law claims, negligent supervision and motor vehicle claims.  He is a civil litigator who has handled all aspects of the defense of personal injury matters through trial verdict in cases involving allegations of premises liability, general negligence and negligent supervision.  One of Lampert’s previous civil trials was discussed in a well-known New York jury verdict reporter for his successful introduction into evidence of prior, unsworn deposition testimony as a Business Record during a jury trial in which he obtained a Defense Verdict for his client.

Robert A. Maloney, of Oceanside, is a member of the Insurance Coverage Practice Group.  Maloney represents insurance companies in complex coverage disputes, including cases involving allegations of asbestos, silica, benzene, toxic torts, general liability, auto liability and environmental contamination.  He has represented insurance companies in some of the largest coverage cases in the country, including B.F. Goodrich, Chevron, Mine Safety Appliances and several PCB-related matters filed in connection with the cleanup of the Fox River in Wisconsin.

Sean McAloon, of Long Island City, is a member of the Insurance Coverage Practice Group.  He advises insurance companies in the investigation and litigation of claims arising under homeowner and commercial insurance policies.  Experienced in first-party property coverage, McAloon has assisted clients in claims involving arson, fraud, mysterious disappearance of jewelry, theft, employee dishonesty, property damage and business interruption.  He has helped clients obtain early dismissal in many litigated disputes.

Frank Misiti, of Glen Head, is a member of the Insurance Coverage Practice Group.  Misiti represents clients in insurance coverage litigation, commercial litigation and intellectual property litigation in state and federal courts throughout the country.  He routinely advises insurers on coverage issues arising out of bodily injury, advertising injury, class actions, products liability, medical malpractice claims and environmental and toxic torts.   Misiti gained extensive experience in insurance coverage issues that stemmed from the events of Sept. 11, 2001, including obtaining reimbursement of defense costs incurred by an insurer as part of the World Trade Center exposure lawsuits.
