Raia “Sticks The Landing” and Receives Defense Verdict

Frank Raia received a defense verdict on behalf of Chelsea Piers in a matter in which the plaintiff, a gymnast performing a front handspring, fractured her elbow resulting in elbow replacement surgery.  The claim against Chelsea Piers was that the instructor failed to properly spot the plaintiff, which was the proximate cause of the accident.  With the help of our expert, Olympic Gold Medal winner Tim Daggett, and the behind-the-scenes work of Keith Grover and Amanda Reynolds, the jury concluded that the plaintiff assumed the risk of injury, and that even if the instructor had failed to spot the plaintiff properly, his failure to spot did not unreasonably increase the risk of injury as there was nothing he could have done to prevent the fracture from occurring.
