Professional Liability team defeat two fire loss claims against clients.

David  Wilck and Wendy Crowther, members of the firm’s Professional Liability Practice Group, successfully defeated two fire loss claims against clients Balboa Insurance and Aurora Loan Services, getting them both dismissed on the pleadings.  In the first, the team successfully thwarted subrogation and negligence claims of the neighbor’s insurance company arguing Aurora could not be responsible as an “owner in possession” post Judgment of Foreclosure.  In the second, they successfully argued that the borrower’s public adjuster had no equitable lien on the hazard policy insurance proceeds paid to Aurora for the fire loss.
