Novikoff and Mann Secure Summary Judgment and $250,000 Damage Award After Trial

Ken Novikoff and Greg Mann secured summary judgment on liability and an award of over $250,000, on behalf of our client, R&G Brenner Income Tax Consultants, in an action filed in the Commercial Division Part of Nassau County, Supreme Court.  R&G Brenner established as a matter of law that Defendant, a former tax preparer,  breached the non-solicitation and non-compete provisions of the restrictive covenants associated with his employment, as well as acted faithlessly and disloyally while employed by Brenner.  In addition to enforcing the liquidated damage clause and awarding money damages pursuant to the formula set forth in the LCD, Defendant was ordered to disgorge three years of compensation earned and pay Brenner’s attorneys’ fees related to the legal proceeding.
