Krinick and Gurdus Obtain Summary Judgment On Behalf of Hartford

Krinick |Evan Krinick and Jason Gurdus obtained summary judgment for client, Hartford Accident and Indemnity Co., in a declaratory judgment action in New York State Supreme Court, Suffolk County. Plaintiffs, which included municipalities and a contractor, sought coverage from Hartford for several underlying lawsuits involving damage to roadways, water mains and related facilities resulting from construction work that took place in the 1970s and 1980s. The Court, agreeing with Hartford, ruled that there was no coverage under the policies issued by Hartford as the notice to Hartford of the underlying lawsuits was untimely. The Court also ruled that Hartford is not collaterally estopped from denying coverage because of a prior decision in a related coverage action.
