John Diviney and Scott Green win summary judgment

John Diviney and Scott Green, members of the firm’s Employment & Labor Practice Group, won summary judgment on behalf of their client, a major New York based school bus operator, on claims of interference and retaliation under the Family and Medical Leave Act by a former employee. The Court found that the employee had failed to provide adequate notice of protected leave and that he was terminated for legitimate, nondiscriminatory reasons unrelated to protected activity.
