Grill and Tare Defeat Complaint

David Grill and Joshua Tare, members of the Firm’s Litigation & Appeals Practice Group, were victorious in defeating a tenant’s rent overcharge complaint and failure to renew lease complaint at the Division of Housing and Community Renewal.  Tenant alleged that her rental apartment was subject to rent stabilization and that the landlord had charged more than the legally permissible monthly rent.  The DHCR Rent Administrator determined that, based upon the proper legal increases including, but not limited to, renewal lease increases, a longevity increase, an individual apartment improvement increase, and a vacancy increase, the legal regulated rent exceeded the monthly threshold, and accordingly, landlord lawfully removed the apartment from rent stabilization protections.
