Gorfinkel Obtains Summary Judgment for Insurer Client

Paul Gorfinkel obtained summary judgment in favor of our insurer client in a high-profile case in Connecticut.  The client had issued a homeowners insurance policy to a homeowner, whose basement walls were exhibiting pattern cracking.  The policyholder sought first-party coverage under the “collapse” provisions of the policy, but in a coverage action, the court found that the cracking did not amount to “collapse” under the policy, and granted judgment to our client.

The case is high profile because it is one of several dozen similar cases involving cracking basement walls in Northeastern Connecticut, and the problem has been addressed in the news media and by the state government.  Paul’s case was only the third such case, involving the subject policy language, to proceed to final judgment.
