Glambosky and Honig Victorious on Behalf of Naftali Group

Erez Glambosky and Jeremy Honig obtained a key victory for developer, Naftali Group, by successfully arguing that Naftali was the prevailing party in a hotly contested holdover proceeding after it was awarded summary judgment.  The Court found that Naftali was entitled to recover reasonable attorneys’ fees from the Respondent pursuant to the lease by virtue of its status as the prevailing party since Respondent’s argument that that the apartment was subject to rent stabilization was roundly rejected by the Court and Naftali was awarded a judgment of possession.

This decision will be applauded by landlord’s across New York City as it serves as a reminder that there may be significant pecuniary consequences for tenants who unsuccessfully challenge a landlord’s right to recover possession.
