Eric Strober obtains defense verdict in medical malpractice case

Eric Strober, a partner in the Health Services and Litigation & Appeals Practice Group, obtained a defense verdict in a 3 week medical malpractice/wrongful death case in Queens tried before Judge Allan Weiss. I represented one of two doctors accused of failing to properly diagnose and work up lung cancer in a 61 year old man. The trial lasted three weeks before a jury. Plaintiff’s counsel requested that the jury award $13.75 million. The jury found that the patient likely had stage 4 lung cancer at the time of the alleged malpractice and that any errors did not cause any decrease in the decedent’s opportunity for a cure or any additional pain, suffering or death at age 65.
