Contino and Isaacson Secure Pre-Answer Dismissal

Peter Contino and Deborah Isaacson secured a pre-answer dismissal in the Supreme Court, Suffolk County, of multiple claims against their lawyer clients, including claims for a violation of Judiciary Law Section 487, tortious interference with a contract, abuse of process, trespass and conversion.

In dismissing the action on almost every single ground asserted in our motion, the Court adopted virtually all of the arguments we raised, including lack of personal jurisdiction, collateral estoppel and failure to state a cause of action. Given the Court’s findings, it will likely be very difficult for plaintiff to pursue and succeed on an appeal.
