Bendix Victorious in Queens County Supreme Court

Bruce A. Bendix obtained a defense verdict in the Supreme Court, Queens County, after a three day jury trial.  Plaintiff, a pedestrian, claimed that the defendant, an 88-year old driver, crossed a double yellow line as he was driving westbound on Northern Blvd. in Queens and struck him.  The defense contended that plaintiff, who was crossing in the middle of the road, stepped into the left westbound lane, contacting the left rear view mirror of the defendant’s car.  Plaintiff, who made a $1,000,000 demand, was claiming extensive injuries, including a skull fracture, cognitive impairment and memory loss.  The jury unanimously found that our client, who was 92-years of age when he testified, was not negligent.
