Rivkin Team Victorious In The Second Circuit Court of Appeals

John Diviney, Cheryl Korman, Merril Biscone and Scott Green were victorious in a Second Circuit Court of Appeals decision affirming a summary judgment win on behalf of their client, a major New York based school bus operator, on claims of interference and retaliation under the Family and Medical Leave Act by a former employee. The Court found that the employee had failed to provide adequate notice of protected leave and that he was terminated for legitimate, nondiscriminatory reasons unrelated to protected activity.
