A partner in Rivkin Radler’s Commercial Litigation and Insurance Fraud Practice Groups, Justin is experienced in litigating complex affirmative and commercial litigation matters and has successfully prosecuted numerous actions seeking to recover monies paid by major insurance companies in reliance on fraudulent medical treatment and billing schemes.

Justin also counsels healthcare, automobile, and property insurers on proper claims handling practices and investigation techniques – helping his clients develop fraud prevention, detection, and recovery plans.

Notable favorable decisions include:

  • Mendez v. Behar (E.D.N.Y. 2017) (defeated shareholder defendant’s motion to dismiss complaint for fraud in the inducement, breach of fiduciary duties and unjust enrichment),
  • Walden Bailey Chiropractic, P.C. v. GEICO (Sup. Ct. Erie Cty. 2017) (obtained dismissal of complaint claiming bad faith and seeking consequential and punitive damages),
  • International Rehabilitative Sciences, Inc. vs. GEICO (W.D.N.Y. 2012) (obtained dismissal of complaint seeking consequential and punitive damages for alleged bad faith in claims handling processes),
  • GEICO v. Infinity Health Products, et al. (E.D.N.Y. 2010) (obtained multimillion-dollar judgment against various individuals and entities involved in a complex fraudulent insurance scheme).

Before joining the firm, Justin was a policy analyst for the New York City Mayor’s Office under the Rudolph Giuliani and Michael Bloomberg administrations. As a New Era Democrat, a nonpartisan grass-roots political organization that supports both Republicans and Democrats alike, Justin successfully coordinated and participated in several New York City mayoral and city council campaigns.

Justin is a member of the Croatian American Bar Association, the Association of Croatian American Professionals and is the Executive Vice President of the Islands Medical Assistance Society – a non-profit humanitarian foundation dedicated to providing healthcare services to the people of the islands of Cres, Losinj, Ilovk, Susak, Male and Vele Srakane, and Unije in Croatia.

An avid sports fan, Justin manages Rivkin Radler’s softball team and organizes the Rivkin Radler Charity Bowling League.
