Eric Nemeth represents and counsels companies on environmental concerns, and other matters involving science and technology.
In a legal career spanning more than twenty five years, Eric has represented numerous private and public sector entities, primarily in environmental matters, ranging from environmental compliance to corporate transactions to litigation. His representation of an array of Fortune 100 and start-ups in the context of mergers and acquisitions has included assets in the U.S., Canada, Mexico and overseas.
Eric has directed the investigation and remediation of contaminated real estate in a multitude of venues. His practice includes negotiations with Federal and State agencies from New York to California in matters ranging from air permit acquisition and compliance, fines and penalties for water pollution violations and OSHA compliance. Eric also counsels clients on real estate transfers, including those required by the NJDEP under its ISRA program.
Eric has successfully prosecuted and defended a variety of environmental cost recovery actions, most recently achieving a major property damage recovery on behalf of a governmental entity. He has been responsible for the retention and oversight of numerous engineering and environmental experts and contractors, including development and implementation of programs to monitor contractor performance, work product and conformance with client requirements.
Since 1990, Eric has served as General Counsel to one of the first governmental entity joint insurance funds formed in the State of New Jersey (the “NJIIF”). In his capacity as G.C., and most recently as Co-Administrator of the NJIIF, he has been responsible for the regulatory compliance of the insurance fund and has coordinated the efforts of the numerous professionals that manage its day-to-day operations.
As part of his work with the Firm’s Health Services Practice Group, Eric represents U.S. and European clients on international technology and asset transfers and compliance with the USFDA’s Quality System Regulation/Good Manufacturing Practices associated with the import of medical products and is responsible for obtaining marketing clearance from FDA for numerous innovative medical devices. The Health Services Practice Group has been listed in the prestigious Legal 500. The practice is also recognized as “notable” by Chambers USA.
